Under the 2018 Farm Bill, hemp was federally legalized in the U.S. as long as its Delta-9 THC content stays below 0.3% on a dry weight basis.

That may sound like a rounding error, but here’s the loophole: in a gummy or beverage that weighs several grams, 0.3% can still add up to a solid psychoactive dose, often 10mg or more.

How Is Delta-9 Extracted From Hemp?

There are two primary methods for producing hemp-derived Delta-9: direct extraction from the plant or chemical conversion from CBD.

Is Delta-9 Hemp Safe?

What’s the Difference Between Delta-9 Hemp and Delta 8?

Delta-9 and Delta 8 may sound like close cousins, and chemically, they are, but the difference in how they’re made, how they feel, and how they’re regulated is significant.

Structurally, the difference lies in the location of a double bond in the molecule. 

That small shift makes Delta 8 less potent, usually about 50–70% the strength of Delta-9. 

For some, that makes it a gentler option. For others, it means needing more product to achieve the same effect, which can backfire if the formulation isn’t clean.

The real divergence happens in the extraction process. 

While hemp-derived Delta-9 can be extracted directly from the plant or converted from CBD, Delta 8 almost always starts with CBD and is synthesized through chemical conversion. That process uses acids and solvents, and if not properly purified, the final product can contain unwanted byproducts or residual chemicals.

What Should You Look for in a Hemp-Derived Delta-9 Product?

Start with transparency.

Check for clear dosage.
